La Loi sur les normes du travail ne couvre pas les absences pour « raisons personnelles ». Ainsi, l’employeur est en droit d’exiger un billet médical pour toute absence de plus de 3 jours (selon la jurisprudence) ou lorsqu’il dispose d’un motif sérieux pour le faire (cas douteux, abus, etc.).

Bien qu’il ne puisse exiger un diagnostic, il a le droit d’exiger que le billet présente un minimum d’informations telles : la nature de l’absence (maladie, blessure, etc.), le pronostic, la date de la visite, la signature du médecin et son numéro de pratique. S’il en fait mention à même sa politique interne et/ou avise officiellement l’employé, l’employeur aura le droit de refuser un billet médical ne répondant pas à ces exigences.
