Maintien d’équité : date anniversaire

Saviez-vous que le maintien de l’équité salariale, au sens de la Loi, ne peut être réalisé au moment jugé le plus opportun par l’employeur? Un exercice réalisé trop tôt pourrait ne pas avoir de valeur légale et un exercice réalisé trop tard pourrait entraîné des pénalités.

Effectivement, votre dossier d’équité salariale possède une date dite « anniversaire » sur laquelle vous devez vous baser pour réaliser votre maintien. Cette date anniversaire correspond à la date du NOUVEL AFFICHAGE, soit du dernier affichage réalisé au moment de votre exercice initial.

EXEMPLE : Une entreprise a affiché les résultats de son exercice initial le 15 octobre 2010, puis a réaffiché 60 jours plus tard, soit le 16 décembre 2010. Cette dernière date est appelée NOUVEL AFFICHAGE et correspond à la date « anniversaire » de l’entreprise. Ainsi, aux cinq ans, l’entreprise devra avoir réalisé l’exercice de maintien et en afficher les résultats à jour à cette date. Dans notre exemple, l’entreprise devra donc procéder les 16 décembre 2015, 2020, 2025, etc.

Il va de soit que nous recommandons de prévoir la réalisation de l’exercice quelques semaines, voire quelques mois à l’avance, selon le contexte de votre entreprise. Toutefois, au moment de l’affichage, vous devrez vous assurer que toutes les données soient à jour et représentatives de la réalité.

Attention, cette information est valide pour les entreprises qui n’accusaient pas de retard au moment de l’exercice initial. Si tel est le cas, c’est la date à laquelle l’entreprise aurait dû avoir complété ce NOUVEL AFFICHAGE ou plus tôt, selon la date réelle de cet affichage, qui deviendra la date anniversaire.

Souvenez-vous aussi de votre obligation de compléter ANNUELLEMENT la déclaration de l’employeur en matière d’équité salariale (DEMES), qu’il y ait eu des modifications ou non à votre dossier.
