Que sont les régimes volontaires d’épargne-retraite?
Les régimes volontaires d’épargne-retraite (RVER) sont des régimes d’épargne-retraite auxquels peuvent participer les employés du Québec qui travaillent pour le compte de petites et moyennes entreprises (PME) n’offrant pas déjà à leurs employés la possibilité de cotiser à un régime d’épargne-retraite par l’entremise de retenues salariales. Tous les employeurs du Québec qui n’offrent pas de régime enregistré d’épargne-retraite ni de régime de retraite agréé et qui comptent au moins cinq employés admissibles ayant cumulé un minimum d’un an de service continu seront tenus d’offrir un RVER à leurs employés. Les employeurs comptant moins de cinq employés admissibles peuvent choisir d’offrir un RVER, mais ne sont pas tenus de le faire.
Qui est un employé admissible?
L’employé doit compter un an de service continu. Nous n’avons pas plus de précisions à ce sujet pour l’instant. Le gouvernement du Québec est à finaliser la loi et les règles visant les RVER.
L’emplacement de l’employeur est-il un facteur pris en considération? Est-ce qu’il importe que l’employeur soit situé au Québec ou hors Québec?
L’emplacement de l’employeur n’importe pas. L’employeur est tenu d’offrir un RVER s’il a un établissement au Québec et qu’au moins cinq employés admissibles y travaillent, ou encore s’il a cinq employés admissibles qui travaillent à l’extérieur du Québec mais qui sont domiciliés au Québec ou résidents de cette province.
Que signifie service continu?
Dans la Loi sur les normes du travail, on définit la notion de service continu comme étant « la durée ininterrompue pendant laquelle le salarié est lié à l’employeur par un contrat de travail, même si l’exécution du travail a été interrompue sans qu’il y ait résiliation du contrat et la période pendant laquelle se succèdent des contrats à durée déterminée sans une interruption qui, dans les circonstances, permette de conclure à un non-renouvellement de contrat ».
Les employeurs sont-ils tenus d’offrir un RVER?
Tous les employeurs du Québec qui comptent au moins cinq employés admissibles, et qui n’offrent aucun régime d’épargne-retraite aux termes duquel les cotisations sont retenues à la source, devront offrir un RVER à compter du 1er janvier 2015.
L’employeur qui offre déjà un régime d’épargne-retraite collectif est-il obligé d’offrir un RVER?
Non, à condition qu’il soit possible pour les employés de cotiser au régime par retenues salariales.
Quelle est la date limite à laquelle le RVER doit être établi?
Les premiers RVER feront leur entrée le 1er janvier 2013. Tous les employeurs du Québec qui comptent au moins cinq employés admissibles, et qui n’offrent aucun régime d’épargne-retraite aux termes duquel les cotisations sont retenues à la source, devront offrir un RVER à compter du 1er janvier 2015.
Qu’arrivera-t-il si l’employeur n’a pas établi de RVER au plus tard le 1er janvier 2015?
La Commission des normes du travail se chargera de veiller à ce que les employeurs se conforment à la législation sur les RVER. Nous n’en savons pas davantage pour le moment.
