À compter du 1er janvier 2016, la Commission des normes du travail, la Commission de l’équité salariale et la Commission de la santé et de la sécurité du travail ne feront qu’un. En effet, ces trois organismes aux missions complémentaires uniront leurs forces pour créer le CNESST.
Cette nouvelle organisation sera la porte d’entrée unique pour l’ensemble des services liés aux normes du travail, à l’équité salariale ainsi qu’à la santé et à la sécurité du travail au Québec.
De plus, ce projet de loi ( Loi 42) déposé en avril 2015, crée aussi la fusion de la Commission des relations du travail (« CRT ») et de la Commission des lésions professionnelles (« CLP ») en un seul tribunal, le Tribunal administratif du travail (« TAT »).
Bien que possédant des missions complémentaires, leurs objectifs sont toutefois différentes:
- la CNT (Commission des normes du travail) a pour mandat d’assurer le respect de la Loi sur les normes du travail et de ses règlements. Elle peut aussi prendre les procédures administratives, civiles ou pénales nécessaires pour inciter les employeurs à respecter la Loi ou réclamer les sommes dues à un employé;
- la CSST (Commission de la santé et de la sécurité du travail) gère le régime d’indemnisation des travailleurs victimes d’une lésion professionnelle et veille à l’application de la Loi sur les accidents du travail et les maladies professionnelles, de la Loi sur la santé et la sécurité du travail et de leurs règlements;
- la CÉS (Commission de l’équité salariale) a pour mandat de veiller au processus d’évaluation des emplois pour s’assurer de l’équité salariale entre les employés de sexe masculin et féminin au sein d’une entreprise.
Selon certains experts, il ne serait pas surprenant que des divisions se forment soit une en santé et sécurité, une division des normes et une division des relations de travail.
